These Terms of Service (“Terms”) govern your access to and use of Point4Homes (“Point4Homes”, “we”, “us”, or “our”), including the website point4homes.com, any associated subdomains, applications, and services (collectively, the “Platform”). Please read them carefully. By accessing or using the Platform you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Platform.

1. What Point4Homes is — and is not

Point4Homes is a real estate marketplace for the Riviera Maya (Mexico). The Platform connects prospective buyers and tenants (“Prospects”) with independent licensed real estate agencies and agents (collectively, “Listing Agencies”) who post their own property listings.

Point4Homes is not a real estate broker, agent, agency, escrow agent, attorney, lender, appraiser, or title company. We do not own, list, lease, sell, manage, or represent any property on the Platform. We do not negotiate transactions, hold funds, or act as a party to any purchase, sale, or lease. We provide technology and visibility — nothing more.

2. Listing content and accuracy — full disclaimer

Point4Homes makes no representation or warranty — express or implied — regarding the accuracy, completeness, currency, legality, suitability, or reliability of any listing or related information on the Platform. All listing content is provided “as is” and “as available”.

Full responsibility for the content, accuracy, legal standing, and ongoing availability of any listing rests exclusively with the Listing Agency that posted it.

3. Your duty to exercise caution (Prospects)

Real estate transactions are significant financial commitments. Before relying on any information presented on the Platform, you agree to:

• Verify independently all material facts about a property — including title, ownership, legal status, zoning, permitted use, occupancy, encumbrances, taxes, condo fees, and any pending litigation.
• Inspect the property in person, or commission a qualified inspection, before signing any commitment or transferring any funds.
• Confirm the credentials, license, and authority of the Listing Agency and agent representing the property.
• Engage independent legal, fiscal, and notarial counsel before signing any purchase agreement, lease, or deposit instruction in Mexico, particularly if you are a foreign buyer (e.g. fideicomiso requirements within the Restricted Zone).
• Confirm pricing, currency, payment terms, and the source and destination of all funds in writing with the Listing Agency, and never transfer money based solely on emailed or messaged wire instructions.

Point4Homes urges Prospects to exercise their own caution and independent due diligence. Use of the Platform is not a substitute for professional advice from a licensed broker, attorney, notary public, or financial advisor.

4. Listing Agency obligations

If you submit, edit, or maintain a listing on the Platform, you represent and warrant that:

• You hold all licences, registrations, and authorisations required by Mexican federal, state, and local law to market and broker the property.
• You have the legal right and the seller’s authority to list, market, and represent the property on the Platform.
• All listing information you submit is accurate, current, and not misleading at the time of publication, and you will update or remove it without undue delay if it becomes inaccurate.
• You own or have the right to use all photographs, videos, and other media you upload.
• You will respond to Prospect inquiries promptly and honestly, and you will not engage in bait-and-switch tactics, ghost listings, duplicate listings on the Platform, or any other deceptive practice.
• You will comply with all applicable consumer-protection, fair-housing, anti-money-laundering, and data-protection laws.

Listing Agencies indemnify and hold harmless Point4Homes, its officers, employees, contractors, and affiliates from any claim, loss, liability, damage, or expense (including reasonable legal fees) arising from or related to their listings, conduct, or breach of these Terms.

5. Accounts and security

Some features require an account. You agree to provide accurate information, keep your credentials confidential, enable two-factor authentication where offered, and notify us promptly of any suspected unauthorised use. You are responsible for all activity under your account.

6. Acceptable use

You agree not to:

• post content that is unlawful, fraudulent, defamatory, discriminatory, or infringing;
• scrape, harvest, or reproduce Platform content other than for ordinary personal browsing;
• interfere with the integrity or performance of the Platform, or with another user’s use of it;
• attempt to gain unauthorised access to any part of the Platform or its underlying infrastructure;
• use the Platform to send unsolicited communications, phishing attempts, or to circumvent our anti-abuse mechanisms.

7. Intellectual property

The Platform, its design, code, branding, and original content are owned by Point4Homes and are protected by applicable intellectual property laws. You retain ownership of content you submit but grant Point4Homes a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, and distribute that content as needed to operate and promote the Platform.

8. Third-party links and services

The Platform may link to or integrate third-party websites, services, or APIs (for example, mapping providers, image CDNs, analytics, payment processors, or social media). Point4Homes has no control over and assumes no responsibility for the content, policies, or practices of any third party.

9. Disclaimer of warranties

The Platform and all content on it are provided “as is” and “as available”, with all faults and without warranty of any kind. To the maximum extent permitted by law, Point4Homes disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and uninterrupted availability.

10. Limitation of liability

To the maximum extent permitted by applicable law, in no event will Point4Homes, its officers, employees, contractors, or affiliates be liable to any user or third party for any:

• loss, damage, claim, or expense arising from a listing’s content, accuracy, legality, or availability;
• act, omission, misrepresentation, default, or fraud committed by a Listing Agency, agent, prospective buyer, tenant, or other Platform user;
• indirect, incidental, special, consequential, exemplary, or punitive damages;
• lost profits, lost revenue, lost data, business interruption, loss of opportunity, or reputational harm;

whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, and whether or not Point4Homes has been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless Point4Homes and its officers, employees, contractors, and affiliates from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of or related to your use of the Platform, your content, your breach of these Terms, or your violation of any law or third-party right.

12. Termination

We may suspend or terminate your access to the Platform, in whole or in part, at any time and for any reason — including suspected violation of these Terms, suspected fraud or abuse, or compliance with legal obligations — without prior notice. Provisions that by their nature should survive termination will survive (including disclaimers, liability limits, indemnification, and governing-law clauses).

13. Governing law and venue

These Terms are governed by the laws of the United Mexican States and the State of Quintana Roo, without regard to conflict-of-law principles. Any dispute will be resolved exclusively before the competent courts of Quintana Roo, unless otherwise required by applicable mandatory consumer- protection laws.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Material changes will be announced on the Platform or via email where appropriate. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
